These Terms of Service (“Terms”) govern your use of www.embacharmory.com (the “Site”) and any purchase you make from Embach Armory, LLC (“Embach Armory,” “we,” or “us”). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place orders.
1. Eligibility
You must be at least 18 years old to use the Site, and at least 21 years old to purchase a handgun. You must comply with all federal, state, and local laws that apply to your purchase, possession, and transfer of firearms, ammunition, and accessories. By placing an order you represent that you are not prohibited from receiving firearms under 18 U.S.C. § 922(g) or any other applicable law.
2. Your Account
If you create an account, you are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You are responsible for activity that occurs under your account.
3. Products, Pricing, and Availability
We try to describe products accurately, but we do not warrant that product descriptions, photographs, or specifications are error-free. Prices and availability are subject to change without notice. We reserve the right to correct pricing or availability errors before, during, or after an order is placed.
Photographs of custom-built rifles and parts may show similar — but not identical — units. The exact serial numbers, finish details, and component variations on the rifle you receive may differ from the photos shown.
4. Orders and Acceptance
An order placed through the Site is an offer to purchase, not an accepted sale. Embach Armory may accept or decline any order at our discretion. We may cancel orders for any reason — including suspected fraud, pricing errors, prohibited buyer status, or inability to ship to your jurisdiction — and will refund any payment for a canceled order.
5. Custom Builds
Custom builds and conversion services are made-to-order. The published lead time on each product is an estimate, not a guarantee. Lead times begin once payment has cleared and any customer-supplied parts kit has been received in the shop.
Once a build has begun, materials have been cut, or customer-supplied parts have been processed, the order is non-cancellable except in cases of substantial Embach Armory error or defect. If you need to cancel before work has begun, contact us as soon as possible and we will refund your payment less any sunk costs.
6. Firearm Transfers (FFL Requirements)
All firearm sales are shipped to a Federal Firearms License (FFL) dealer of your choice, not directly to you. You are responsible for selecting an FFL dealer who will accept the transfer, ensuring your FFL dealer sends us a current copy of their license, and complying with all background-check, registration, and waiting-period laws in your jurisdiction.
If your FFL dealer refuses the transfer or you fail to complete the transfer, the firearm will be returned to Embach Armory at your expense and refunded less return shipping, restocking (if applicable), and any direct costs incurred.
7. Shipping
We ship via FedEx, UPS, or USPS as appropriate for the item and destination. Shipping rates are calculated at checkout. Risk of loss passes to you (or to your FFL dealer) on delivery.
8. Returns and Refunds
Returns and refunds are governed by our Refund and Returns Policy, which is incorporated into these Terms by reference. Custom builds and personalized work are non-returnable except in cases of manufacturing defect covered under warranty.
9. Warranty
Every firearm built by Embach Armory is warranted against defects in craftsmanship and function for the lifetime of the build, on the terms described on our Customer Support page. The warranty does not cover normal wear, improper ammunition, user modification, or damage from abuse, neglect, or accident.
10. Acceptable Use
You agree not to use the Site to violate any law, infringe any third party’s rights, transmit malicious code, attempt to gain unauthorized access to our systems, or interfere with the operation of the Site.
11. Intellectual Property
All content on the Site — including text, logos, photographs, and product descriptions — is owned by Embach Armory or licensed to us, and is protected by copyright and trademark law. You may not reproduce, redistribute, or use Embach Armory content for commercial purposes without our prior written permission.
12. Disclaimers
THE SITE AND THE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR THE EXPRESS WARRANTY DESCRIBED IN SECTION 9, EMBACH ARMORY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Firearms are inherently dangerous. You assume all risk associated with the possession, handling, transport, storage, and use of any firearm or accessory you purchase from Embach Armory.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EMBACH ARMORY’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF USE.
14. Indemnification
You agree to indemnify and hold Embach Armory harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of any product, or your violation of any applicable law.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site or products will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top will reflect the most recent revision. Continued use of the Site or placement of new orders after a revision constitutes acceptance of the revised Terms.
